The state’s renewable portfolio would have new caps on penalties for violations under a proposed California Public Utilities Commission decision. The Oct. 16 proposal for utilities’ penalty cap is $75 million for the first three-year compliance period from 2011-2013; $75 million for the second period from 2014-2016; $100 million for the third period of 2017-2020; and $25 million for each annual compliance period beginning in 2021. For small retailers, it’s set at a lower rate using a formula that reflects the shortfall. The proposed decision also clarifies various enforcement procedures—including reporting requirements and issuance of citations—and outlines how to obtain waivers from the renewable energy requirement.
