Attorney General Jerry Brown said he would fight Calpine’s bankruptcy plan to get rid of the generator’s supply contract with the Department of Water Resources. DWR “could receive less than the $150 million of value ascribed” to its share determined by the bankruptcy court, according to the attorney general in a motion to stay that part of the bankruptcy proceeding August 1. The state wants the district court to enforce the pact to keep Calpine from interfering with Federal Energy Regulatory Commission-jurisdictional contracts. PG&E officials supported the AG’s move, saying if the contract is obliterated, it would add costs to the utility’s ratepayers. Calpine had no comment on the filing, leaving it up to the courts.
