The Enron tapes figured prominently in a last-minute amendment to the energy and water appropriations bill passed by the House late last week. The bill, HR 4614, was amended by Representative Anna Eshoo (D-California) to read that ?none of the funds made available in this Act may be used to deny requests for the public release of documents or evidence obtained through or in the Western Energy Markets: Enron Investigation, the California Refund case, the Anomalous Bidding Investigation, or the Physical Withholding Investigation.? The hotly debated amendment would initially have required the Federal Energy Regulatory Commission to allow full participation by states in the investigations and force regulators to disclose all information gathered in the course of investigations. She also tried to eliminate the refund effective date, which FERC member Suedeen Kelly says could free up another $4 billion in potential refunds (<i>Circuit</i>, June 25, 2004). The initial amendment was blocked by the chair of the Rules Committee, but the aforementioned language was passed. The bill goes to the Senate.
